At Affordable Gates and Fences, we’ve noticed more and more homeowners asking about what are the rules around fencing and gates around swimming pools. So we thought we’d sum it all up simply.
Pool fencing requirements
Here’s a quick breakdown of what’s required:
- Fence Height: It needs to be at least 1.2 metres tall all the way around.
- Gaps: Any gaps in the fence or under it must be less than 100mm.
- Climb-Proof: There shouldn’t be anything a child could use as a foothold — no horizontal bars, for example.
- Distance from the Pool: It should be at least 900mm from the edge of the water.
Gate requirements
For Tauranga, pool gates need to:
- Swing away from the pool
- Be self-closing and self-latching
- Have the latch placed high enough to be out of reach (1.5m if accessed from outside)
If your latch is located inside the gate, it can be a bit lower — but it still needs to be at least 1.2m high.
Portable Pools & Spa Pools
Pools ≥ 40cm Deep: Any pool that is capable of holding water to a depth of 40cm or more requires a compliant safety barrier, regardless of whether it is filled to capacity or not.
Side Walls ≥ 1.2m High: If the side walls are at least 1.2 meters high and cannot be climbed, a barrier may not be required. However, if a ladder is used to access the pool, it must be removed or secured when not in use to prevent access by children.
Spa pools must follow these rules unless they have a lockable, child-safe cover.
If you’re using a ladder to access an above-ground pool, it either needs to be locked in place or removed when not in use.
Inspections and Fines
In Tauranga, the first swimming pool barrier inspection is included as a targeted rate in your property rates, meaning you won’t be charged separately for it. But if your pool barrier and fencing doesn’t pass the initial inspection, and needs a follow-up assessment, there will be an additional fee of $174.90 per inspection. Fines for non-compliant pool gates and fences are $500, and that’s without the re-inspection fee. So it’s best to get it right the first time!
